Terms of Service

1. Who we are

OpenBias ("we", "us") is operated by OpenBias, France. Contact: support@openbias.io. These Terms govern your use of openbias.io and api.openbias.io (the "Service").

2. What the Service is — and what it is not

OpenBias provides educational, informational market-bias context derived from algorithmic analysis of price data. The Service does not provide investment advice, investment recommendations, trade signals, or portfolio management within the meaning of MiFID II or any other regulation. Nothing in the Service constitutes an offer, solicitation, or recommendation to buy or sell any financial instrument. All outputs (bias, confidence, verdicts, zones, statistics) are educational context about historical and current price behavior. You alone are responsible for your trading decisions and risk management. Trading foreign exchange, CFDs, and cryptocurrencies carries a high risk of loss.

3. Eligibility

You must be at least 18 years old and legally able to enter into contracts.

4. Accounts

You are responsible for your credentials and all activity under your account. Provide accurate information and keep it current. One account per person unless agreed otherwise.

5. Plans, billing, cancellation

Free tier: limited features, no charge. PRO: $29/month, or $15/month billed annually. API: $149/month, or $99/month billed annually. Prices in USD, exclusive of applicable taxes. Payments are processed by Stripe; we do not store card details. Subscriptions renew automatically until cancelled; cancel anytime in your account — access continues to the end of the paid period; no pro-rated refunds except where required by law. EU consumers: by starting the subscription you request immediate provision of digital content and acknowledge that the 14-day withdrawal right is lost once the service is fully provided; where it applies, withdrawal within 14 days of first purchase is honored per EU consumer law.

6. Acceptable use

You may not: resell, redistribute, or publicly rebroadcast Service data without written permission; scrape, crawl, or bulk-extract data beyond documented API allowances of your tier; reverse engineer the Service; use the Service to build a competing dataset; interfere with or overload the Service; use it for unlawful purposes. API tier usage is subject to documented rate limits.

7. Intellectual property

The Service, its software, models, statistics, design, and content are our property or licensed to us. You receive a personal, non-exclusive, non-transferable licence to use the Service per your tier.

8. Availability & changes

The Service is provided "as is" and "as available". We may modify, suspend, or discontinue features. We aim for high availability but do not guarantee uninterrupted operation, accuracy, or fitness for any particular purpose. Market data is supplied by third parties and may be delayed, incomplete, or erroneous.

9. Disclaimer & limitation of liability

To the maximum extent permitted by law: we disclaim all warranties; we are not liable for trading losses, lost profits, or indirect, incidental, or consequential damages arising from use of the Service. Our total aggregate liability is limited to the fees you paid us in the 12 months preceding the claim. Nothing limits liability that cannot be limited under applicable law, nor EU consumers' statutory rights.

10. Data protection

Our processing of personal data is described in the Privacy Policy (openbias.io/privacy).

11. Termination

You may stop using the Service anytime. We may suspend or terminate accounts that breach these Terms, with notice where practicable. Sections 7–9 survive termination.

12. Governing law

These Terms are governed by French law. Mandatory consumer-protection rules of your country of residence remain unaffected. Disputes: courts of France, or your local courts where consumer law so provides. EU ODR platform: ec.europa.eu/consumers/odr.

13. Changes to these Terms

We may update these Terms; material changes will be announced in-product or by email at least 14 days in advance. Continued use after the effective date constitutes acceptance.
